Unless expressly provided otherwise, the terms below, which are otherwise capitalised in these general contract terms, or in other documents between the parties, are to be understood as follows:
"Third party" means the natural or legal person, public authority, agen-cy or any other organisation, other than the User, nor the Controller, nor the persons authorised under the direct authority of the Controller to process the data;
"External Service Providers" means service providers engaged by the Respondent for the provision of goods and services. This includes e.g. pay-ment service providers, website hosts, transport companies and email or newsletter senders.
"GDPR" means General Data Protection Regulations, or the General Data Protection Regulation of 27 April 2016, as amended, updated and/or sup-plemented from time to time;
"GDPR terms and policy" means the terms and policy on personal da-ta, the subject of this document.
"User" means any natural person who enters one or more personal data on the Website.
"Interactive use" means any use of the Website in which You actively enter personal data on the Website, whether through an electronic form com-pleted by You or otherwise.
"Non-interactive use" means any use that cannot be considered an In-teractive Use.
"Controller" means the controller of personal data, as designated in Ar-ticle 5.
"Processor" means NV Euro Soap, having its registered office at Sprie-testraat 166 in 8792 Desselgem (Waregem) and registered in the Crossroads Bank for Enterprises under number 0417.611.526.
"Website" means the website on which the User has entered his or her personal data.
2 SCOPE
Each visit to and use of the Website is subject to these GDPR Terms and Policies. If applicable, entering personal data on the Website implies that the User has actual knowledge of the GDPR Terms and Policy and has ac-cepted its contents. These GDPR Terms and Policies are subject to change without notice. It is therefore recommended that you consult these GDPR Terms and Policy each time you visit.
3 PROCESSED DATA
3.1 NON-INTERACTIVE USE
A purely Non-interactive use of this website does not involve the pro-cessing of personal data within the meaning of the GDPR.
3.2 INTERACTIVE USE
In case of Interactive use of the Website, including creating a profile and/or placing an order, the personal data entered by the User during the regi-stration procedure are processed. These personal data include, depending on the function used by the User on the Website, (i) company name and data, (ii) personal contact name, (iii) contact data and (iv) payment data.
By interactively using the Website, the User grants his unambiguous consent to the processing of the personal data he has entered.
3.3 GOOGLE ANALYTICS / COOKIES
Both Non-interactive and Interactive use of this Website involves the use of Google Analytics, a web analysis service offered by Google Inc. More specifically, Google Analytics uses so-called "cookies".
Cookies generally record data relating to the browsing behaviour of visi-tors and users on the Website (pages consulted, date and time of consultation, search criteria used, etc.). The visitor's IP address is also recorded. These da-ta allow the Website, among other things, to recognise the visitor on subse-quent visits and to propose adapted content.
However, the visitor can refuse the use of cookies by changing the set-tings for cookies in the configuration menu of his/her web browser, with a pos-sible impact on certain functionalities of the Website. The visitor can also ge-nerally prevent Google from collecting and using his/her data (IP address and cookies) by downloading and installing the browser plug-in.
4 PURPOSES OF PROCESSING
The Respondent processes personal data received through this website and account for the following purposes:
• communication with the User;
• managing the User's profile;
• processing orders;
• organising after-sales service;
• making the website easily accessible (by means of so-called cookies);
• communication for direct marketing purposes (such as mailings or posts via social media such as Facebook, Instagram, LinkedIn, etc.);
5 CONTROLLER
The Website is owned and operated by the Euro Soap. Controller can be reached by telephone at +32 56714977, e-mail at [email protected] and, if necessary, by ordinary or registered mail at the address mentioned in the afo-rementioned paragraph.
6 DATA RECIPIENTS
Personal data processed may be communicated to the following reci-pients depending on the purposes of processing, and the need to do so;
• the User and Respondent itself, as well as its commercial partners for commercial purposes, such as mailings;
• the hosting providers and the application development service provider or web builder;
• in case of purchase with online payment: to the financial institution and payment service provider used by the Responsible Party;
• external Service Providers needed to execute and complete the order (e.g. the payment service providers, the carrier, ...).
The aforementioned recipients will only process personal data received in accordance with these GDPR Terms and Policies. A processor agreement will also be concluded with each of them.
7 RETENTION OF DATA
The data will not be kept for longer than necessary in the context of its processing and taking into account the aforementioned purposes and the ex-pected commitments of the Processor, including its legal obligations.
8 CONFIDENTIALITY OF DATA
The Processor shall take the necessary measures to protect the perso-nal data against unauthorised access or modification, use or disclosure without the User's consent, and destruction or (accidental) loss. Employees who have access to personal data are required to respect its confidential nature.
9 RIGHT OF ACCESS, RECTIFICATION AND OPPOSITION
The User who knows how to identify himself/herself always has the right to consult his/her data, to correct erroneous and/or incomplete data and to oppose the use of these data for direct marketing, free of charge, without having to provide any justification.
The User who knows how to identify himself/herself may also request the Processor to remove, free of charge, all his/her personal data from the Processor's database. The Processor shall make every effort to comply with this request as soon as possible.
The User who feels short-changed is also always entitled to lodge a complaint with the controlling authority, the Belgian Data Protection Authority (https://www.privacycommission.be/).
10 SOCIAL PLUGINS
The Respondent uses social plug-ins of the social network face-book.com, instagram.com, linkedin.com and pinterest.com on the Website. The plug-ins are indicated by a Facebook, Instagram, Linkedin or Pinterest logo. When the User visits the Website, which contains such a plug-in, the User's browser establishes a direct connection to the servers of Facebook, In-stagram, Linkedin or Pinterest. The content of the plug-in is transmitted by Facebook, Instagram, Linkedin or Pinterest directly to the browser.
By integrating the plug-in on the Website, Facebook, Instagram, Lin-kedin and Pinterest receive the information that the User has requested the page in question. If the User has an account and is logged in, Facebook, In-stagram, Linkedin or Pinterest can link the User's visit to the respective page as well as the use of the plug-in on that page (e.g. clicking the "Like" button), to the User's account. The purpose and scope of the data collection, further processing and use of this data, as well as the relevant rights of the User and the setting options to protect his privacy, are exclusively determined by Face-book, Instagram, Linkdedin and Pinterest. Likewise, Facebook, Instagram, Linkedin or Pinterest, or someone within those organisations, is the controller for the processing of this data.
If the User does not want Facebook, Instagram, Linkedin or Pinterest to collect data in the aforementioned manner, he should opt out before visiting the Website.
